2. The petitioner has approached this Court seeking a direction upon the respondent-BTSC to consider the contractual

Patna High Court CWJC No.11445 of 2025(2) dt.28-07-2025 2/3 services of the petitioner, working as Community Health Officer, equivalent at par with the contractual services of General Nursing and Midwifery as well as Auxiliary Nurse Midwife and accordingly to grant the benefits of weightage points of contractual services to the petitioner in terms with the Advertisement No.23/2025.

3. Learned Advocate for the Commission referring to Clause (v)(a) and (b) of Advertisement No.23/2025 submits that there is specific stipulation with regard to extending the benefit of equivalence of the service and proportionate percentage of the marks; however, it is the admitted position that the petitioner has served as Community Health Officer on contractual basis. Moreover, the writ petition is premature as till date even written examination has not been conducted, which is scheduled to be held on 30th July, 2025 to 4th of August, 2025.

4. At this juncture, learned Advocate for the petitioner seeks permission to approach before the authorities concerned for ventilation of petitioner's grievance.

5. Considering the submissions advanced by the learned Advocate for the respective parties, the present writ petition stands disposed off with a liberty to the petitioner to approach before the concerned authorities.

6. In case, such a representation is filed, the same shall be considered and disposed off expeditiously in accordance with law.

7. It is made clear that the Court has not expressed any opinion on the merit(s) of the case.
