JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-09-2019 Learned counsel for the petitioner submits that by order dated 03.04.2019, this Court was pleased to grant provisional bail directing the petitioner to surrender within four weeks and to furnish bail bond, however, due to communication gap, the petitioner did not surrender before the court below and did not furnish bail bond within time but a modification application for modification of order dated 03.04.2019 was filed by the petitioner in July, 2019 which remained pending before this Court and at the time of final order passed by this Court on 26.08.2019, this fact could not be brought to the notice of this Court and accordingly, this Court by order dated 26.08.2019

Patna High Court CR. MISC. No.61145 of 2019(2) dt.26-09-2019 2/2 was pleased to confirm the provisional bail of the petitioner dated 03.04.2019.

Learned counsel submits that ten days further time may be granted to the petitioner in order to furnish bail bond pursuant to order dated 03.04.2019 read with order dated 26.08.2019.

As prayed for, ten days further time from today is granted to the petitioner to enable him to furnish bail bond before the court below in terms of order dated 03.04.2019 read with order dated 26.08.2019. Accordingly, order dated 26.08.2019 is modified to the aforesaid extent.
