Petitioner seeks regular bail in connection with Daudnagar P.S. Case No. 325 of 2020 registered for the offence under Section 354(B), 376, 511 of the I.P.C. and Section 8 / 12 of the POCSO Act.

The allegation against the petitioner as per the First Information Report is that on 05.10.2020 the informant along with his wife heard the sound of crying of their 04 years old daughter and upon being asked the reason she said that while she was playing the petitioner took her to the nearby cottage and opened her pant and touched her private parts.

No.2595 of 2021(3) dt.06-04-2021 2/2 Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to land dispute between the parties. Learned counsel further submits that the parties have now compromised the matter which has been stated in the supplementary affidavit filed on 25.03.2021. Having regard to the submissions made by learned counsel for the parties, taking into consideration the materials available on record and the nature of allegation, I am not inclined to grant regular bail to the petitioner. Accordingly, the same stands rejected.
