In this case the petitioner is seeking bail in connection with Nabinagar P.S. Case No. 186 of 2015 for offence under Section 392 of the Indian Penal Code.

The two unknown persons have entered into the house of the Informant and, on the point of pistol, they have taken out materials mentioned in the First Information Report and fled away. The Informant has alleged that he could not see the face of the person who was standing outside the room but, can identify that person by way of voice.

The order of the court below itself shows that the petitioner was caught and his confessional statement was recorded

Patna High Court Cr.Misc. No.6332 of 2016 (2) dt.26-02-2016 and later on the looted materials were also recovered from the possession of Prince Kumar and Umakant Dubey. Looking to the entire facts and circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, namely, Manoj Patel is rejected.

The trial court i.e. the court of Chief Judicial Magistrate, Aurangabd is directed to conclude the trial of the petitioner within a period of ten months from the date of receipt/production of a copy of this order.
