The petitioner seeks pre-arrest bail in connection with K. Hat Sahayak P.S.Case No. 382 of 2017 registered under Sections 366, 366-A, 376, 450 of the Indian Penal Code and Section 3 and 4 of the POCSO Act.

Regard being had to the fact that initially a police case was instituted in which the alleged victim made her statement under Section 164 of the Code of Criminal Procedure wherein she has not uttered a word against the petitioner and the police submitted final report, which was accepted and the present case has been instituted on the basis of a complaint in respect of the same offence, in the event of arrest or surrender before the court

Patna High Court Cr.Misc. No.624 of 2018 (2) dt.11-01-2018 2/2 below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Purnea in connection with K. Hat Sahayak P.S.Case No. 382 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
