The petitioners apprehend their arrest in connection with Muffasil (Gaya) P.S. Case No.352 of 2022, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioner no.1 has got one criminal antecedent whereas rest of the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail

Patna High Court CR. MISC. No.56031 of 2022(2) dt.20-12-2022 2/2 application. It is further submitted that similarly situated coaccused has already been enlarged on anticipatory bail by this Court vide order dated 28.11.2022, passed in Cr. Misc. No.42301 of 2022.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Considering the fact that similarly situated co-accused person has already been enlarged on anticipatory bail by this Court, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Muffasil (Gaya) P.S. Case No.352 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
