JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to prosecution case itself, it was co-accused, Md. Afroz who called the deceased on telephone and after that deceased was taken away by Md. Touseef. Although, it is stated that motorcycle of the petitioner was used in taking away the deceased but the motorcycle of the petitioner was not found on the place of occurrence. Moreover, except the aforesaid material, there appears to be nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.7456 of 2016 (2) dt.17-02-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. Case No. 239 of 2015.
