The petitioner seeks pre-arrest bail in connection with Barharia P.S. Case No.51 of 2015 registered under Sections 147, 148, 149, 341, 323, 308/504 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there is general and omnibus allegation against nine persons and the injuries sustained by the informant and his wife are all simple and superficial. He submitted that the petitioner has got roots in the society having no criminal antecedent, he is not likely to abscond or tamper with the evidence. The allegations made against him are absolutely false. He also submitted that some of the accused persons have already been granted pre-arrest bail by

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner.

Considering the nature of allegation as also the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Barharia P.S. Case No.51 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
