The petitioner apprehends his arrest in connection with Durgawati P.S. Case No. 138 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. In the first information report, the driver has not taken the name of this petitioner. Further he submits that the driver of the alleged vehicle took the vehicle on the pretext to carry his near relatives for treatment to Varanasi and while returning, on the way, the vehicle of the petitioner was seized, but the driver denied the occurrence as alleged in the first information report. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 138 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
