Originally, informant filed Complaint Case No. 261/2014 against one Ahmad leveling allegation of rape against him and on the basis of the aforesaid complaint case, Kishanganj Mahila P.S. case no. 12/2014 was registered against said Ahmad but in course of investigation statement of informant was recorded under section 164 Cr.P.C in which she stated that two years ago this petitioner committed rape twice on her and petitioner has been made accused in this case though earlier he was referred as witness in Complaint Case No. 261/2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
