The petitioner seeks regular bail in a case registered under Section 302 and other sections of the Indian Penal Code. Rambha Devi, the informant, made allegations that Arbind Yadav and Subhash Yadav (the petitioner) assaulted her husband with iron rod and her husband died.

Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was rejected vide order passed in Cr. Misc. No. 1867/2014, but co-accused Arbind Yadav, against whom there is similar allegation, has already been granted bail on 14.11.2014 passed in Cr. Misc. No. 10547/2014. The petitioner is in jail since 19.09.2013.

It appears that similarly situated co-accused Arbind Yadav has already been enlarged on bail.
