The petitioner seeks bail in Rajepura P.S. Case No. 47 of 2013, registered for the offences punishable under Section 448 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

The informant lodged the case against unknown alleging therein that some persons came in search of Dr. Rajesh Kumar Singh, but the informant replied that the doctor is not available thereafter, the accused persons opened firing. Learned counsel for the petitioner submits that the petitioner is not named in the FIR, nothing has been recovered from the possession of the petitioner. Name of the petitioner

Patna High Court Cr.Misc. No.4225 of 2015 (2) dt.02-02-2015 figured in the case on mere suspicion. Co-accused Lallan Prasad Kushwaha @ Lallan Kumar Kushwaha and Shyam Nandan Kushwaha @ Shyam Nandan Kushawaha have already been enlarged on bail vide order passed in Cr. Misc. No. 43734 of 2014 and Cr. Misc. No. 1506 of 2015 and the case of the petitioner stands on the same footing.

Having considered the facts aforesaid and the fact that the petitioner is not named in the FIR, name of the petitioner figured on mere suspicion and the petitioner was not put on test identification parade, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Rajepur P.S.
