The petitioner seeks bail in a case instituted for the offences under Sections 304(B), 120(B) and 506/34 of the Indian Penal Code.
As per allegation marriage of Babita Kumari was solemnized with Roushan Kumar according to Hindu rite but after some time the marriage could not run smoothly. They started demanding dowry and were also torturing the victim. Ultimately it was informed that Babita Kumari has been killed by the family members of in-laws.
From the order sheet it appears that the body was found in such a bad condition, as her neck was cut and body was
Patna High Court Cr.Misc. No.6427 of 2016 (3) dt.10-03-2016 2/2 raptured and in a very ghastly manner the victim was killed. Learned counsel for the petitioner submits that husband and father-in-law are already in jail and petitioner was not a party for perpetration to the victim and she is an old lady. Petitioner has produced the Election Commission identity card which shows 33 years age on 1.1.1994, on calculation it comes to 55 years who cannot be said to be an old lady. Petitioner is in jail since 24.8.2015.
As petitioner (Sunita Devi) is a lady and has been languishing in jail since 24.8.2015, let her be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Vth, Begusarai in connection with Dandari P.S. Case No. 48 of 2015, G.R. No.3516 of 2015.
