JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-09-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 06.01.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Paroo P.S. Case no. 467 of 2019, registered under Sections 307/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 30, 30 (a) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that on receiving secret information about unloading of illicit liquor at old sugar mill of Raju Singh in village-Tarwa Majhaulia, the informant along
Patna High Court CR. MISC. No.2343 of 2021(2) dt.16-09-2021 2/3 with other Police personnel reached there then in the light of torch they saw that cartons of liquor are being unloaded. When informant and other Police personnel started to surround the truck then firing was started. Thereafter, SDPO and officer-incharge of Debariya Police Station were informed. On seeing the arrival of other Police parties, all started fleeing. On reaching near the truck, one person was found in the truck, who disclosed his name Dharmendra Das and he also disclosed that the alleged cartons of liquor are being unloaded by Ramnarayan Singh and his son Chandan Kumar. He further disclosed that 15 persons named in the F.I.R. along with Chandan Singh, son of Ramnarayan Singh and this petitioner were indulged in unloading the liquor. On search, several bottles of Indian Made Foreign Liquor in volume of 2499.840 Litres recovered.
Learned counsel for the petitioner submits that petitioner was not apprehended on the spot mere on suspicion the name of petitioner has been surfaced in this case. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below
Patna High Court CR. MISC. No.2343 of 2021(2) dt.16-09-2021 3/3 within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Paroo P.S. Case No. 467 of 2019, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
