09-11-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners, in the present, case, are seeking Anticipatory Bail in connection with Patliputra P.S. Case No. 50/2017 for the offences under Sections 363, 366(A), 34 of the Indian Penal Code pending in the court of learned Sub-Judge-XII cum - A.C.J.M., Patna. Learned counsel for the petitioners submits that these petitioners are the parents of the boy Hritik Kumar. In the F.I.R. it is alleged that the Hritik Kumar and other named accused persons had been instrumental in kidnapping of the daughter of the informant, but when the daughter of the informant made her statement under Section 164 Cr.P.C., not only that she disclosed her age as

Patna High Court Cr.Misc. No.53929 of 2017 (2) dt.09-11-2017 19 years, but also affirmed that she had gone to Delhi with the boy Hritik Kumar on 06.02.2017 and had married with him on 18.02.2017. She has further stated that her husband has surrendered in Patliputra Police Station and she is not willing to go with her parents as they were not happy with her marriage with Hritik Kumar, but so far as these parents are concerned, they have been falsely implicated in the present case.

Considering the facts and circumstances, in the event of their arrest/surrender before the court below within a period of four weeks, let the petitioners abovenamed be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XII cum - A.C.J.M., Patna in connection with Patliputra P.S. Case No. 50/2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that they will co-operate in investigation in the present case.
