JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Mirganj, P.S. Case No. 20 of 2013 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. The petitioner was allowed bail vide Criminal Misc. No.14669 of 2014 by order dated 29.05.2014 but as he was involved in more than two cases, he was not released on bail resulting he is suffering in custody since 7.9.2015. Learned A.P.P. fairly submits that earlier the petitioner has disclosed regarding only two more cases but he is involved in five cases.

No.5987 of 2016 (2) dt.19-02-2016 2/2 In the facts and circumstances stated above, now considering the period of detention of the petitioner he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagisgtrateIII, Gopalganj in connection with Mirganj P.S. Case No. 20 of 2013, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
