Petitioner being elder brother-in-law of deceased is languishing in jail custody since 20.08.2014 in a case registered under sections 304B, 201/34 of the IPC.

The contention on behalf of the petitioner is that petitioner is separate from deceased's husband.

However, from perusal of first information report, I find that informant did not disclose the year of marriage at the time of institution of the case but in spite of that police registered case under sections 304B, 201/34 of the IPC.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
