The petitioners seek regular bail in Gopalpur P.S. Case No. 123 of 2013, registered for the offences punishable under Section 302 and 34 of the Indian Penal Code. The allegation is that the petitioners along with Rudal Chaudhary and Teju Chaudhary slit the neck of the deceased.
The learned counsel for the petitioners submits that from perusal of the First Information Report itself it would appear that the informant is not an eye-witness of the occurrence. The informant alleged that his brother was killed inside the room but the police found the dead body on the Varamdah. No blood
Patna High Court Cr.Misc. No.3676 of 2015 (2) dt.28-01-2015 was found either inside the room or on the Varamdah. Co-accused Rudal Chaudhary and Teju Chaudhary have already been granted bail vide order passed in Cr. Misc. Nos. 14567 and 2014 and 11482 of 2014.
Having considered the fact that Rudal Chaudhary and Teju Chaudhary have already been enlarged on bail and there is same and similar allegation against the petitioners, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalpur P.S. Case No. 123 of 2013.
