JUSTICE BIRENDRA KUMAR ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

The F.I.R. relates to murder of the son of the informant by unknown person.

The petitioner was abruptly arrested without any prior evidence and his confessional statement was recorded by the police as submitted by learned counsel for the petitioner. The only material is confessional statement of the petitioner before police, which is not admissible as evidence in the eyes of law. Considering the facts and circumstances, let

Patna High Court Cr.Misc. No.8577 of 2017 (2) dt.01-03-2017 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Patna City at Patna/Successor Court, in connection with By-pass P.S.
