ANJANA PRAKASH ORAL JUDGMENT Date: 20-08-2015 The Petitioner seeks revision of the judgment of conviction dated 03.12.2014 passed by the Ad hoc Additional Sessions Judge-VIII, Purnia in Criminal Appeal No. 9 of 2014, by which he has affirmed the judgment dated 18.01.2014 passed by the Judicial Magistrate, 1st Class, Purnia in G.R. Case No. 4142 of 2013, by which he has convicted the Petitioner under Sections 25(1-B) A and 26(i) of the Arms Act and sentenced him to undergo R.I. for two years and fine of Rs. 3,000/- and three years and fine of Rs 3,000/-.
Having gone through the judgment of conviction, I do not find any reason for interference with the same.
However, considering the period of custody and
Patna High Court CR. REV. No.161 of 2015 dt.20-08-2015 the date of occurrence, the sentence is reduced to the period already undergone by the Petitioner. However, he is required to pay a sum of Rs. 3,000/- under each count in default the sentence shall run as awarded by the Court below.
With the aforesaid modification in sentence, the Revision Application stands dismissed.
