JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Ballia P.S. Case No. 291 of 2015 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1b)a , 26 and 35 of the Arms Act. Allegedly, one country made loaded pistol and one more live cartridge were recovered from possession of the petitioner when he along with others had assembled to make preparation for committing dacoity and the petitioner is suffering in custody since 06.08.2015 having no criminal antecedent. Other co-accused have already been allowed bail by another co-ordinate

In the facts and circumstances stated above, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri. S. Uraon, learned A.C.J.M.-III, Begusarai in connection with Ballia P.S. Case No. 291 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
