JUSTICE SANJAY PRIYA ORAL ORDER 12-02-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bikram P.S. Case No. 97 of 2013 instituted for the offence under Sections 147, 148, 149, 323, 325, 307, 233, 353 and 201 of the Indian Penal Code.

It is alleged in the written report filed by S.I. of Excise, Bikram, that on the date of occurrence at 10:15 a.m. when they were searching the excise materials in village Sundarpur Musahari Tola, the petitioner along with other accused persons named in First Information Report and 50-60 unknown persons attacked on the search team and caused injury to the members of the raiding party as mentioned in the written report. Case diary has been received.

No.60717 of 2017 (3) dt.12-02-2018 2/2 The injury report of five injured persons is available in the case diary which shows that five members of the raiding party have sustained injuries in the occurrence. As such, there is serious allegation against this petitioner of causing obstruction in discharging official duty of the raiding team and also causing injury to them after assault. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
