JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is husband of the deceased and is languishing in jail custody since 12.09.2014 in a case which was initially registered under section 304B and 201/34 of the Indian Penal Code but after investigation police submitted charge sheet under section 306 of the Indian Penal Code.

No doubt, in course of investigation, some witnesses claimed that petitioner being husband of the deceased used to torture her because she was not able to produce any child but there appears to be nothing in the impugned order of learned Additional Sessions Judge to show this fact that the act of the petitioner compelled the deceased to commit suicide.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.3460 of 2015 (2) dt.27-01-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhojpur in connection with Piro( Hasan Bazar)P.S.Case No. 216 of 2014.
