The petitioner apprehends his arrest in connection with Aurangabad Mufassil P. S. Case No. 123 of 2017 instituted under Sections 379 and 411/34 of the Indian Penal Code and Section 3(2)(E) of Damage of Public Property Act. Learned counsel for the petitioner submits that petitioner is a truck owner and other persons had hired the truck for transportation purposes and other co-accused Vinit Kumar Pandey and Pravin Kumar, having similar allegation, earlier were admitted to anticipatory bail by this Court vide order dated 18.10.2017 passed in Cr. Misc. No. 50194 of 2017 and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.52864 of 2017 (2) dt.09-11-2017 2/2 circumstances, let the petitioner, namely, Tuntun Kumar Gupta, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Mufassil P.S.Case No. 123 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
