The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, four F.I.R. named persons, including this petitioner, and some unknown persons pelted stones on the police party to obstruct them in arresting two accused persons, as a result of which, the informant sustained head injury.

It is submitted on behalf of petitioner that as per F.I.R. itself, there is no specific overt act against this petitioner. Allegation of pelting stones is general and omnibus. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.48212 of 2022(2) dt.13-12-2022 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Rajauli P.S. Case No. 360 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
