JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-07-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.
The petitioner seeks bail in a case for the offences punishable under sections 147, 148, 149, 302 and 201 of the I.P.C Allegedly, the petitioner and other eight FIR named accused persons dragged Sonmatia Devi from her house, took away towards PAIN east to the village and when the informant tried to rescue her, the accused person ran to kill the informant also and after killing the mother of the informant hide the dead body. The accused persons were claiming mother of the informant as DYNE.
Submission is of false implication and that against the petitioner there is no specific allegation, the allegations are general
Patna High Court Cr.Misc. No.6355 of 2016 (3) dt.05-07-2016 2/2 and omnibus in nature, nothing has been recovered from possession of the petitioner and the petitioner is suffering in custody since 08.10.2015.
The learned A.P.P. opposes prayer for bail.
In the facts and circumstances as stated above, considering the allegation attributed against the petitioner, at present I am not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Karpi (O.P. Shahar Telpa) P.S. Case No. 133 of 2015 pending in the court of Sri Om Prakash, J.M. 1st Class, Arbal (Jehanabad). However, he may be at liberty to renew his prayer for bail after remaining one year in custody.
