JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-11-2021 Learned counsel for the petitioners undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard Mr. Bimlesh Kumar Pandey, learned counsel for the petitioners and Mr. Tapeshwar Sharma, learned APP for the State. This modification application has been filed seeking modification of the order dated 27.01.2021 passed in Cr. Misc. No. 28561 of 2020.
Learned counsel for the petitioners submits that the petitioner was earlier granted anticipatory bail vide order dated 27.01.2021 passed in Cr. Misc. No. 28561 of 2020 but due to circumstances beyond their control they could not surrender before the learned court below within the given period.
Patna High Court CR. MISC. No.58471 of 2021(2) dt.24-11-2021 2/2 Learned counsel for the petitioners has in course of his submissions, having sensed that there is inordinate delay in moving this Court for extension of time offers to deposit a sum of Rs.3,000/- (Rupees Three Thousand only/-) in the Patna High Court, Legal Aid Committee.
Having regard to the facts and circumstances stated in the application, this Court thinks it just and proper to extend the period indicated in the operative part of the order dated 27.01.2021 passed in Cr. Misc. No. 28561 of 2020 by another two weeks from today. As a result of this order in the event of their arrest/surrender before the learned court below within a period of two weeks from today the above named petitioners shall be given the benefit of the order dated 27.01.2021.
Let such deposit be made within one week from today and the receipt showing deposit of the amount shall be placed before the learned court below with the bail bonds in order to satisfy that the order of this Court has been fully complied with.
