The petitioner is languishing in custody since 03.09.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The informant Jainath Yadav alleged that 5-6 unknown criminals intercepted the truck and robbed the money from the driver and they also took away the truck of the informant. It is submitted by learned counsel for the petitioner that the petitioner's name sprang up in confession of the co-accused. The petitioner has not been put on TIP till date, statement to that effect has been made in para 6 of the petition,

Patna High Court Cr.Misc. No.4666 of 2015 (02) dt.05-02-2015 2/2 and similarly situated co-accused Sabha Khan has been granted bail vide Cr. Misc. No. 26526 of 2014.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Dorigaon) P.S. Case No. 1056 of 2010.

Since the petitioner is accused in four other cases, the learned court below will cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions. (Dinesh Kumar Singh, J) DKS/- U T
