JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-01-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Hasanpur P.S. Case No. 80 of 2017 registered for the offence punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

The allegation of the prosecution is that while Panchayati was being held between the informant side and the accused persons pertaining to the land dispute, the accused persons had assaulted the prosecution side resulting in various types of injuries.

The learned counsel for the petitioners submits that the injuries sustained by the informant side are simple in nature,

No.63650 of 2017 (3) dt.15-01-2018 2/2 however, opinion with respect to some of the injuries has been kept reserved, nonetheless, the same are said to have been inflicted on non vital parts and moreover, no specific overt act has been alleged as far as the petitioners are concerned. It is further submitted that compromise has taken place between the parties, hence, the petitioners may be granted the privilege of anticipatory bail. It is further submitted that the petitioners are own brother and father of the informant.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IIIrd, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 80 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
