JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-01-2018 The learned counsel for the State has raised a preliminary objection regarding the maintainability of the present writ petition in as much as the respondent IBPS does not fall within the definition of the "State" as defined in Article 12 of the Constitution of India. He further submits that IBPS being a public trust, is registered under the Bombay Public Trust Act, 1950 and also under the Societies Registration Act, 1860. The learned counsel for the petitioner seeks permission to withdraw the present writ petition to avail appropriate remedy available under the law.
Permission is granted.
