The petitioner seeks bail in a case registered under Sections 379, 376/511, 307/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioner under a conspiracy abducted the victim and they along with some unknown persons attempted to commit rape with her. There is further allegation of physical assault by knife by co-accused Murari Kumar Bhagat.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.1.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.44776 of 2019(2) dt.22-07-2019 2/2 against the petitioner. The petitioner has falsely been implicated in the present case due to previous enmity. No allegation of assault is alleged against the petitioner. Allegation of assault is against co-accused, namely, Murari Kumar Bhagat. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Udakishunganj (Madhepura) in connection with Chausa P.S. case No.300 of 2018.
