The petitioner apprehends his arrest in connection with Sonepur P.S. Case No.218 of 2015 registered under Sections 366(A)/34 of the Indian Penal Code.

The accusation is that the minor daughter of the informant, in the evening of 03.06.2015 at about 06.30 P.M., moved from the house to attend the call of nature but she did not return. In course of search of his daughter, the informant came to know that the petitioner alongwith his associate Dilip Kumar Rai with the help of Sanjay Rai and Ajay Singh kidnapped his daughter.

Learned counsel for the petitioner submits that, in fact, the petitioner has falsely been implicated in this case, on mere suspicion,

In her statement, as recorded under Section 164 of the Code of Criminal Procedure, the victim, the daughter of the informant (Annexure-2 to this application), has stated that while she had gone to attend the call of nature, at that time, Ajay Rai, Dilip Kumar and Santosh Rai came on four wheeler vehicle and forcibly got boarded her on the vehicle. Thereafter, she was taken to Jhaua Tola and, later on, she was boarded on the Punjab Mail Train at Dighwara Railway Station and was taken to Punjab. She has not disclosed the name of the petitioner.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Sonepur P.S. Case No.218 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
