This application, for grant of anticipatory bail, arises out of Hajipur Sadar P.S. Case No. 462 of 2017, disclosing offences under Sections 147, 148, 149, 341, 342, 323, 504, 506, 324, 307, 353, 188, 333, 427, 379 and 120B of the Indian Penal Code, Section 27 of the Arms Act and Sections 4/40(8) of B.M.M.C. Act.
Learned counsel for the petitioner has submitted that other co-accused person, namely, Ajay Rai, has been granted anticipatory bail by this Court vide order, dated 20.12.2017, passed in Cr. Misc. No. 60284 of 2017. He has further submitted that the allegation against this petitioner is identical to the case of
Patna High Court Cr.Misc. No.48666 of 2017 (4) dt.05-01-2018 2/2 said co-accused, Ajay Rai.
Considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 462 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself/herself before the police/Court, as the case may be, as and when required and in the event of failure on his/her part to appear before the Court on two consecutive occasions, his/her bail bond shall be liable to be cancelled.
