JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Sikandra P.S. Case No. 236/18, disclosing offences under Sections 385 and 387 of the Indian Penal Code. Allegation as per F.I.R. is of demand of extortion of Rs. Five Lakhs from mobile no. 9134481596, which belonged to petitioner.

Submission of learned counsel for the petitioner is that she is a lady and has falsely been made accused in this case and it is true that the mobile number belonged to the petitioner but her mobile was lost in June 2018 and, thereafter, she had not used the said number. However, there is nothing on record to show that she has got any information entered in the station diary with respect to the loss of same or lodged any case with regard to loss of her mobile.

Patna High Court CR. MISC. No.46433 of 2019(2) dt.26-07-2019 2/2 Learned counsel for the State opposed the prayer for bail and submitted that the mobile number from which, the ransom was demanded belonged to the petitioner. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
