The petitioners are languishing in custody in a case registered for the offences punishable under Sections 33, 34, 36 of the Bihar Prohibition & Excise

The prosecution case in brief is that a U.D. case was registered and during investigation, it was found that husband of the informant died due to consumption of adulterated wine and later on F.I.R has been registered.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. The petitioners are not named in the F.I.R and their names subsequently transpired on the basis of confessional statement of coaccused. Nothing has been recovered from the conscious possession of the petitioners. It is further submitted that on the alleged date of occurrence, the petitioner/Ranjeet Kumar was in judicial custody in connection with Amba P.S. Case No. 34 of 2021. The petitioners are languishing in custody since 19.01.2023.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be

Patna High Court CR. MISC. No.49154 of 2023(2) dt.11-08-2023 3/3 released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, 1st, Nawada in connection with Nawada P.S. Case No. 680 of 2021.
