JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 120B and other sections of Indian Penal Code.

As per prosecution case, a list of forged SIM card holders which is said to be obtained fraudulently on the basis of forged and fabricated documents from different Telecom companies and name of the petitioner finds place at page 8 of the said list.

Learned counsel appearing for the petitioner submits that the SIM card no. 8002690129 is valid and genuine and the same has been purchased by the petitioner on his voter ID. It is further submitted that petitioner has lost his mobile set containing the said SIM card prior to institution of the present

Patna High Court CR. MISC. No.47792 of 2022(2) dt.13-12-2022 2/2 case and Sanha regarding the same has also been filed by the petitioner. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Aurangabad in N.T.P.C. Khaira P. S. Case No. 14 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
