The petitioner apprehends his arrest in connection with Chausa P.S. Case No.179 of 2017 registered under Sections 461 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of the informant regarding theft of the mobile sets from his shop, the present case was lodged against unknown. In course of investigation, some stolen mobile sets were recovered from the betel shop of Shambalak Kumar and the house of Lalu Kumar. In his confessional statement, Shambalak Kumar disclosed the name of the petitioner and Lalu Kumar having their hands in the theft of
Patna High Court Cr.Misc. No.51827 of 2017 (2) dt.06-11-2017 2/2 mobile sets from the shop of the informant. Except that, there is nothing against the petitioner to show his involvement in the commission of the alleged offence. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Udakishunganj, DistrictMadhepura, in connection with Chausa P.S. Case No.179 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
