The petitioner seeks regular bail in a case registered under Section 420 and other sections of the Indian Penal Code. According to the prosecution case, the allegation is that the petitioner took Rs. 2,85,000/- from the informant and others for sending them to foreign country. It is alleged that out of the aforesaid amount, Rs. 85,000/- was transferred in the account of the petitioner.

Learned counsel for the petitioner submits that during the course of investigation, the petitioner was not the holder of the account in which the money is said to have been transferred. There is no chit of papers to show that the petitioner received the amount from the informant and his relations.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.3132 of 2015 (2) dt.22-01-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Barharia P.S. Case No. 16 of 2014.
