JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners and others having formed an unlawful assembly entered the house of informant and petitioner no.1 is said to have opened fire causing fire arm injury to injured Anil Bhagat whereas petitioner no.2 fired but firing did not hit to any person. Furthermore, it is alleged that petitioners committed loot and misbehaved with the inmates of informant's house. It is admitted position in the first information report that the alleged occurrence took place on account of land dispute.

Learned counsel for the petitioners points out that

Patna High Court Cr.Misc. No.8059 of 2016 (2) dt.24-02-2016 2/2 injured Anil Bhagat sustained simple injury said to be caused by firearm and except the aforesaid injured, none has sustained any injury nor anything was recovered from possession of the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners are in jail custody since 7.1.2016, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S.K. Singh, Judicial Magistrate, 1st Class, Saharsa in connection with Baktiyarpur P.S. Case No.482 of 2015.
