1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Sadar P.S. Case No. 378 of 2023 dated 28.04.2023 registered for the offence(s) punishable under Section(s) 295(A), 153(A) and 124(A) of the Indian Penal Code and Section 66 of I.T. Act.

3. The main submissions advanced by the learned counsel for the petitioner are that as per FIR the petitioner is 19 years old and presently he is studying in 12th Class at G.C.S.S. Inter College, Purnea and the alleged Facebook post showing disaffection towards the country was not posted by him rather some other person misused his Facebook account and posted the alleged anti-national post and for the alleged wrong petitioner

Patna High Court CR. MISC. No.48880 of 2023(2) dt.04-08-2023 2/2 has been sufficiently punished as he has been languishing in jail since 29.04.2023 and against him the investigation has been completed and his educational career will be ruined if he is not released on bail and in the past he did not remain indulged in such type of alleged activity.

4. Learned APP appearing for the State opposes the bail prayer.

5. Considering the above submissions and mainly the petitioner's young age, his educational career, his fair and clean antecedent and the completion of investigation against him, this court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be enlarged on bail in connection with Sadar P.S. Case No. 378 of 2023 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Rajiv/- U T
