The petitioner has prayed for bail in connection with S. Tr. No. 153 of 2017 arising out of Aurai P.S. Case No. 178 of 2016 registered for the offence punishable under Sections 341, 324, 307, 302, 504, 506 and 34 of the Indian Penal Code. As per allegation in the FIR, the petitioner is said to have assaulted the grandson of the informant with knife as a result of which he died.

The report was called for in the instant case from the court below. As per the report of I/C 4th Additional District & Sessions Judge, Muzafarpur, contained in letter dated 14.08.2019, the prosecution has examined 12 witnesses. It has further been stated that steps are being taken for expeditious

Patna High Court CR. MISC. No.46800 of 2019(4) dt.25-09-2019 2/2 disposal of the case which is expected to conclude within two months after recording the statement of accused persons under Section 313 Cr.P.C.

In view of the aforesaid facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail and, as such, his application for bail stands rejected. The trial court is directed to expedite and conclude the trial.
