JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that petitioner is languishing in jail custody since 12.07.2014, only on the accusation that she facilitated the other accused in taking thumb impression of the informant on plain paper, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalsingsarai in connection with Ujiarpur P.S.Case No. 72 of 2013.

However, before parting with this order, I think it proper to mention here that the present case was registered on the basis of complaint petition and the Additional Sessions Judge 4th

Patna High Court Cr.Misc. No.2788 of 2015 (2) dt.22-01-2015 2/2 without applying his judicial mind rejected the prayer for bail of the petitioner. The concerned official should be more cautious and judicious at the time of considering of bail petitions. Let copy of this order be communicated to the Additional District and Session Judge- IVth, Samastipur/ concerned court.
