Statement of victim has been recorded under section 164 of the Cr.P.C in which she stated that she had left her home by her own sweet-will.

No doubt, victim disclosed her age as 15 years but the learned Magistrate who recorded the statement of the victim assessed her age as 17 years and the Medical Board found her between 17 to 18 years.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Katihar (Town) P.S. Case no. 753/2015. shahid (Hemant Kumar Srivastava,J) U T
