The petitioner seeks bail in connection with Sonbarsa P. S. Case No.285 of 2019, instituted for the offences under Section 307/ 34 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 16.01.2020, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that on order of Meena Devi, the petitioner along with four named accused persons fired at the informant causing injury in the stomach of the informant as one bullet hit him.

The learned counsel for the petitioner submits that

No.58355 of 2021(2) dt.07-03-2022 2/2 from bare perusal of the allegation as alleged in the F.I.R., it would manifest that the allegation of firing is general and omnibus in nature. No specific allegation of firing is alleged against the petitioner and co-accused Chandan Kumar has been granted bail by order dated 15.12.2020 in Cr. Misc. No.33501 of 2020.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and co-accused has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P. S. Case No.285 of 2019. The application stands allowed.
