====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the opposite party Nos. 2 and 3.
2. The petitioners apprehend arrest in connection with Chanan P.S. Case No. 17 of 2023 for the offences punishable under Sections 498A, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
3. Learned counsel appearing on behalf of the petitioners submits that the dispute between the parties has been settled through process of mediation. The terms of settlement mutually
Patna High Court CR. MISC. No.53812 of 2024(4) dt.07-01-2025 2/2 agreed upon by the parties and the same is kept at 'Flag-M'.
4. Learned counsel for the opposite party No. 2 does not dispute the aforesaid contention.
5. Having considered the fact that the dispute between the parties has already been resolved through mediation, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail-bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Chanan P.S. Case No. 17 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. with further condition that petitioners shall abide by all the terms & conditions, mentioned in Memorandum of Agreement dated 19.11.2024 before the Mediation Centre, failing which, learned Court below shall be at liberty to cancel the bail-bonds of the petitioners.
