The petitioner apprehends his arrest in connection with Banka P.S. Case No. 43 of 2017 registered under Sections 302/34 of the I.P.C. pending in the Court of C.J.M., Banka. Submission is that petitioner is innocent and has falsely been implicated in this case. The occurrence took place due to land dispute between the parties.

Learned A.P.P. appearing on behalf of the petitioner opposed the prayer of the petitioner by contending that there is direct allegation against the petitioner and the witnesses have also supported the prosecution version in several paragraphs of the case diary. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
