The petitioner seeks bail in connection with Rajnagar P.S. Case No. 197 of 2020 instituted for the offences under Sections 341, 504, 323, 324, 325, 307 and 379/34 of the Indian Penal Code. Learned counsel for the petitioner submits that charge sheet came to be submitted under Sections 341, 504, 323, 324, 325, 302 and 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.07.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and the informant alleges that named accused persons along with 30-35 unknown accused came variously armed at the house of the informant and assaulted the informant fracturing his right hand and right arms, further informant's son, along with Pradeep Jha and

Patna High Court CR. MISC. No.58218 of 2021(2) dt.07-03-2022 2/2 Bhogendra Jha were also assaulted and Bhogendra Jha died during the course of treatment and the occurrence was on account of dispute relating to water.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and there is a delay of six days in lodging the First Information Report and coaccused namely, Jeevan Ram & Maghi Ram @ Mahgi Ram have been granted bail by order dated 27.05.2021 passed in Cr. Misc. No. 23506 of 2021.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1st, Madhubani in connection with Rajnagar P.S. Case No. 197 of 2020.
