Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in connection with Rajgir P.S. Case No. 23 of 2020 registered for the offences punishable under Sections 25(1B)(a), 26 of the Arms Act. The factual matrix of the case in short, based on the written report of the informant is that on 20.01.2020, on secret information that a veteran criminal named as the petitioner that he has arrived at his home at Rajgir. On this, a police team was formed and raid was made at his home. On search, a country made pistol loaded with .315 bore was reocovered from the right side of his waist in the jeans paint and a 315 bore live
Patna High Court CR. MISC. No.3845 of 2021(2) dt.26-03-2021 2/2 cartridge was also recovered from his conscious possession. Learned counsel for the petitioner submits that one loaded pistol with two live cartridges has been recovered from possession of the petitioner. Petitioner is in jail custody since 22.01.2020. Petitioner has ten criminal antecedent mentioned in paragraph-3 of the bail petition.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Rajgir P.S.
