JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Petitioner is languishing in custody since 08.09.2014 in a case registered for the offences punishable under Sections 376(C), 120(B) of the I.P.C and Sections 4, 6, 8, 10, 17, 18 of the Prevention of Children from Sexual Offences Act whereas after investigation charge-sheet has been submitted under Sections 376(C), 120(B) of the I.P.C, Sections 4, 6, 8, 10, 17, 18 of the Prevention of Children from Sexual Offences Act and Sections 3(1)(xi), 3(2)(v) of the SC & ST (Prevention of Atrocities) Act.
It is alleged by Kiran Kumari @ Soni that during her stay in Uttar Raksha Grih, Muzaffarpur, co-accused Mamta Devi asked her to talk with Indrajeet and sleep with him in the night as he has agreed to marry with her. The petitioner was also asked by Mamta Devi to ask the victim to talk with Indrajeet. The impugned order reflects that the informant was
Patna High Court Cr.Misc. No.4950 of 2015 (2) dt.05-02-2015 2/2 subsequently found pregnant.
It is submitted by learned counsel for the petitioner that for the same incidence Muzaffarpur Mahila P.S. Case No. 26 of 2013 was lodged by the victim Kiran Kumari @ Soni whereas the present case has been lodged by the Assistant Director of Zila Samajik Suraksha Kosang-Cum-Zila Bal Sanrakshan Ekai, Muzaffarpur. It is further submitted that petitioner has been granted bail in connection with Muzaffarpur Mahila P.S. Case No. 26 of 2013 and the thrust of accusation is against Mamta Devi who has also been granted bail vide Cr. Misc. No. 7249 of 2014.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POSCO, Muzaffarpur in connection with Sadar(Mahila) P.S. Case No. 28 of 2013.
