Petitioner is languishing in custody since 24.02.2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.
Accusation is of committing robbery in the house of the informant.
It is submitted by the learned counsel for the petitioner that he is not named in the First Information Report and his name surfaced on the confessional statement of co-accused Govind Kr. Ojha and Suresh Paswan. There is no recovery from the possession of the petitioner and nor the petitioner has been put on T.I.P. After conclusion of investigation, charge-sheet has been submitted under Section 395 of the Indian Penal Code.
Patna High Court Cr.Misc. No.3367 of 2015 (2) dt.27-01-2015 Considering that the petitioner has not been put on T.I.P., let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K.
